What I'm good at:
Property Settlement & Financial Matters
Yes, you can settle your financial separation without going to court, in fact you are required to try all out of court options first. Most couples successfully resolve their property division through negotiation and/or mediation.
Parenting Matters
There is no automatic presumption of equal shared time, the best interests of the child is the paramount consideration.
Divorce
Once you have been separated for 12 months you can apply for a divorce. This is a separate process to formalizing a financial settlement which you can do at any stage. You must formalize your financial settlement within 12 months of a divorce order being granted or you will first need to obtain the leave of the court.
Consent Orders if you want to ensure that your financial settlement is binding and enforceable you will need to either formalize that agreement with either consent orders or a financial agreement.
